Please note that when responding to recruiters you will be dealing with them directly and as such any contracts and/or arrangements will be formed between you and them, without Sky Superiority as a party and Sky Superiority cannot be held liable for your use of or any liability arising out of the same (save to the extent required by law).

Whilst we try to ensure that the standard of the Website remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. Information Submitted by You

We at SKYsuperiority will/may use information supplied by you to aid the recruitment process and its associated administrative functions as well as to facilitate the purchase of training courses made through this website. We will process any data which you provide in completing the online registration or application forms and any further forms, assessments or personal details which you complete or provide to us when using the Website in accordance with relevant data protection legislation.

Please note that all Third Party recruitment agencies have agreed to our Terms and Conditions and should they be found to be in breach of the Terms and Conditions, they will be prevented from using our services. Further details on this matter can be found within this document

Transfer outside the EEA: Personal information comprising your CV may be accessed through the skysuperiority.com database by third parties outside the European Economic Area (“EEA”). This could happen for instance, if you apply for a vacancy where the employer is based outside the EEA.

– To ensure that content from our site is presented in the most effective manner for you and for your computer.
– To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes.

Terms of Business

Recruitment: Each employment assignment or placement arising as a result of an introduction made by SKY superiority will be subject to our standard Terms of Business as they are applicable in the circumstances. All prospective employers and clients for whom we arrange assignments or placements will be provided with a copy of the Terms of Business applicable to them at or following registration. Separate terms and conditions also apply to the use of our Recruiter site.

Training Courses: Any training course purchased through this website will be subject to the terms issued by the course providers.

Employers/Recruiters are solely responsible for the content of any of their postings on the site. We may offer support and ideas, but any specifications such as gender, height, weight and other assumptions detailed on job posts are not of our specification and simply reflect the needs of the employer. Anything deemed discriminatory should be raised with the employer directly. SKY SUPERIORITY is not an employer and shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs.

You understand and acknowledge that if You cancel Your sky superiority employer account or Your sky superiority employer account is terminated, all Your account information from sky superiority – including saved CVs, network contacts, and email mailing lists – may be marked as deleted and may be deleted from sky superiority databases. CV’s unused on the account may be stored securely on our database under our user agreement and terms.

Sky Superiority Job Posting

A Job posting may not contain:

(1) misleading, unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined in SKY SUPERIORITIES reasonable discretion;

(2) the names, logos or trademarks of unaffiliated companies other than those of your customer save where expressly agreed by Sky Superiority;

(3) the names of colleges, cities, states, towns or countries that are unrelated to the posting;

(4) inaccurate, false, or misleading information; and

(5) Material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under 16.

You may not use Your Sky Superiority job posting or Sky Superiority to:

(6) post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;

(7) post any business opportunity that requires an up front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents; (type rating costs are not an upfront cost and are generally conducted in agreement with the airline or employer)

(8) endorse a particular political party, political agenda, political position or issue;

(9) promote a particular religion

SKY SUPERIORITY reserves the right to remove any job posting or content from the SKY SUPERIORITY Site

CV Database

Use of the SKY SUPERIORITY CV Database by Employers

You shall use the SKY SUPERIORITY CV Database as provided in these Terms and in any contract You have with SKY SUPERIORITY. You shall use the SKY SUPERIORITY CV Database in accordance with all applicable privacy and data protection laws, and You agree You shall not further disclose any of the data from SKY SUPERIORITY CV Database to any third party, unless you are an authorised recruitment agency, staffing agency, advertising or other agency or using the CV explicitly for employment purposes.

You shall take appropriate physical, technical, and administrative measures to protect the data You have obtained from SKY SUPERIORITY CV Database from loss, misuse, unauthorised access, disclosure, alteration or destruction. You shall not share CV Database seat-based license login credentials with any other party, nor share CV Database pay-per-view license login credentials with any party.

The SKY SUPERIORITY CV Database shall not be used:

(1) For any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any CV holders;

(2) To source candidates or to contact job seekers or CV holders in regards to career fairs

In order to ensure a safe and effective experience for all of our customers, SKY SUPERIORITY reserves the right to limit the amount of data (including CV views) that may be accessed by You in any given time period. These limits may be amended in SKY SUPERIORITY’S sole discretion from time to time.

Should it be discovered that CV information has been misused by employers utilising the Sky superiority database, we retain the right to terminate the contract between Sky superiority and said employer, especially in instances where it is breach of Data Protection laws.

Links to Other Sites

The SKY superiority site contains links to third party Web sites. SKY superiority is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third-party Web sites, You do so at Your own risk.

Working Timelines

At Sky superiority we aim to process all applications made via our website within 5 working days. For any enquiries left on our website, we aim to respond within 3 working days. Whilst we aim to keep within these timelines, our ability to do so will depend on the volume of traffic on our site and any existing deadlines we may have to abide by that may take priority. Therefore, there may be instances where we work outside of these expected timescales. In the event of this happening, we will endeavour to keep the relevant party informed about the delay and the reasons for delay. We at Sky superiority will not be held liable for any delay in the performance of our obligations or any consequences of the delay that may follow.

Content Rights

The rights in material on the Website are protected by international copyright, software and trademark laws and you agree to use the Website in a way which does not infringe these rights. You may copy material on the Website for your own private or domestic purposes, but no copying for any commercial or business use is permitted.

Security and Passwords

In order to register with the Website and to sign in when you visit the Website, you will need to use a username and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. Scope of SKY superiority Obligations

Sky Superiority may provide the work-seekers’ details and/or information to hirers. Sky Superiority will use reasonable endeavours to confirm that the work-seeker is willing to work in the proposed position. Furthermore, Sky Superiority will use reasonable endeavours to check the identity of the hirer and the nature of its business, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the hirer considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by the work-seeker or whether there are any requirements imposed by law or otherwise for a work-seeker to satisfy before taking up a position.

The Regulations seek to ensure that work-seekers are only proposed by Employment Agencies for roles for which they are properly qualified and that hirers are only offered work-seekers who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. It is recommended, if you are a work-seeker that you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are a recruiter, to ensure a work-seeker’s suitability for your role. These could include:

1. If you are a work-seeker; checking the identity of the hirer and the nature of its business, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the hirer considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by you as a work-seeker or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position.

2. If you are a hirer; checking the identity of the work-seeker and that the work-seeker has the experience, training, qualifications and authorisation required by law or otherwise for the position and whether there are any requirements imposed by law or otherwise for you, as the hirer, to meet to enable a work-seeker to take up a position.

Changes to Terms and Conditions and Invalidity

These terms and conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use the Website following any amendment.

If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Force Majeure Clause

Neither Sky Superiority nor You shall be held liable for failure or delay in the performance of its obligations under this Contract, if such performance is delayed or hindered by the occurrence of an unforeseeable act or event which is beyond the reasonable control of either party (“Force Majeure Events”).

Acts or events constituting Force Majeure Events shall include, but not limited to Act of God, government intervention, directives or policies.

The party affected by a Force Majeure Event shall notify the other as soon as reasonably practicable after commencement of a Force Majeure Event.
